End User Software License Agreement

READ CAREFULLY BEFORE ANY INSTALLING OR DOWNLOADING THIS SOFTWARE. 

This Software is only for users of Delphion. You cannot use this Software to analyze any patent data except data downloaded from "Delphion Web Site" for this Software. "Delphion Web Site" means the Delphion web sites on the WWW located at the following URL: http://www.delphion.com and/or any mirror or successor URL, and pages connected to it and/or any successor URL.

This Wisdomain End User License Agreement is a legal agreement between you (either an individual or a single entity) and Wisdomain Inc. By installing, downloading, copying, or otherwise using any part of this Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install, download, copy, or otherwise use this Software.

This Software is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The Software is licensed, not sold.

1. Grant of license.
This License agreement permits you to use one copy of this Software on a single computer. This Software is in "use" on a computer when it is loaded into temporary memory (i.e. RAM) or installed into permanent memory (e.g. hard disk, or other storage device) of that computer. You may make a copy of this Software solely for backup or archival purposes.

2. Prohibitions and restrictions.
* You may not reverse-engineer, reverse-compile, disassemble, or use any other method to convert this Software into a human-readable form, nor may you allow another person to do so.
* This Software may not be modified, lent, leased, sold, distributed, licensed or disposed of in any other way in part or in whole.
* The creation of derivative works based on the content of this Software is also prohibited. 

3. Termination.
This Agreement is effective until terminated.  You may terminate this Agreement at any time by destroying all copies of this Software.  This Agreement will terminate immediately without notice from Wisdomain if you fail to comply with any provision of this Agreement. Upon Termination, you must destroy all copies of this Software.

4. Copyright.
All rights, title, and copyrights in and to this Software and any copies of this Software are owned by Wisdomain. Therefore, you must treat this Software like any other copyrighted material.

5. No warranties.
The entire risk arising out of use or performance of this Software remains with you. To the maximum extent permitted by applicable law, Wisdomain, its licensors, and its distributors disclaim all warranties, either express or implied, including, but not limited to, implied warranties or conditions of merchantability, fitness for a particular purpose, title and non-infringement, with regard to this Software.

6. No liability for consequential damages.
To the maximum extent permitted by applicable law, in no event shall Wisdomain, its licensors, or its distributors be liable for any damages whatsoever (including, without limitation, damages for loss of business profit, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of, inability to use, this Software, or the condition of or failure to provide support services, even if Wisdomain has been advised of the possibility of such damages.
